Homaru

Terms

Version v2 · Effective October 6, 2026

Este documento solo está disponible en inglés. La versión en inglés es la que rige.

These Terms are an agreement between you and Hetunex Labs LLC, a Texas limited liability company ("Homaru", "we", "us"), which operates Homaru at behomaru.com and in the Homaru app. They apply to customers who book home services through Homaru and to service providers who carry them out. Our Privacy Policy and Text Message Policy explain how we handle your information and messages.

Please read section 15 carefully. It requires most disputes to be resolved by individual arbitration instead of in court, and it waives class actions and jury trials. You can opt out within 30 days, as section 15 explains.

1. Using Homaru

1.1 You must be at least 18 years old and able to enter into a binding contract to use Homaru.

1.2 You must give accurate information, keep it up to date, and keep access to your phone number and account secure. You are responsible for what happens in your account.

1.3 Homaru currently serves the Dallas–Fort Worth area. We do not accept requests for addresses outside the area we serve.

2. What Homaru does

2.1 Homaru arranges home services. When you request a job, approved service providers quote for it from their own rate cards, within our pricing rules. We choose the service provider for your job and show you one price before you book. You do not receive competing quotes.

2.2 Service providers are independent businesses. They are not our employees or agents, and Homaru does not itself perform the work. The service provider who does your job is responsible for the work.

2.3 "Homaru Certified" means we have approved a service provider for the services listed on their profile. It is not a government license, a guarantee of the work, or a statement that we have checked the provider's criminal history.

3. Booking a job (customers)

3.1 The price. The price shown when you accept is the price for the work described in your request. It includes any minimum charge or surcharge shown to you before you accept, and any sales tax that applies. We do not add a booking fee or service charge to it.

3.2 Extra work. If the service provider finds the job is genuinely larger than described, they must stop and tell you. Extra work is a new job with its own price, which you accept before it is done. Nothing is added to the price you accepted without your agreement.

3.3 The service provider. We assign a service provider approved for the trade and near enough to reach you. If you would rather not have a particular service provider return, tell us and we will not send them to you again.

3.4 Access and safety. You agree to give the service provider safe access to the work area at the agreed time, and to tell them about anything at the property they should know to work safely.

4. Cancelling (customers)

4.1 You can withdraw a request at no charge within 10 minutes of making it, as long as no service provider has been assigned.

4.2 After that, you can ask to cancel, with a reason, until the work has started. We or the assigned service provider will review the request and tell you the outcome.

4.3 We do not currently charge a cancellation fee. If we introduce one, it will be shown to you before you book, and it will not apply to jobs booked before it was introduced.

5. Paying (customers)

5.1 You can pay by cash or by card, where card payment is offered for your job. You will see which options are available before you accept the price.

5.2 Cash. You pay the service provider directly when the job is complete. The service provider, and you, record the payment in the app.

5.3 Card. When you accept the price, you save a card for the job. Your card is not charged then. It is charged for the accepted price after you confirm that the work is done. If you neither confirm nor report a problem, our staff may review the job and, if the work appears to be complete, charge your card.

5.4 Card payments are processed by Stripe. For card payments, Homaru acts as the service provider's limited payment collection agent: when your card payment is received by us, your obligation to pay the service provider for that job is satisfied. We do not store your full card number.

6. When something goes wrong (customers)

6.1 If you are not satisfied with the work, tell us through the job screen or by contacting support within 7 days after the job is completed, and before arranging your own repair. If you arrange your own repair first, we may not be able to help with the cost.

6.2 We will review what happened and, where we agree the work was not done as described, we will do one or more of the following: ask the service provider to return and put it right, send a different service provider, or give a full or partial refund. Refunds of card payments go back to the card used. These are your remedies against Homaru for the quality of the work, except where the law gives you rights that cannot be limited.

7. Service providers

7.1 Your business. You are an independent business. You decide how, and with what tools, staff and materials, you do the work. You may decline any job, and you may work for anyone else. Nothing in these Terms makes you our employee, partner or agent.

7.2 Licenses, insurance and taxes. You must hold, and keep current, every license and permit your trade and each job require, and commercial general liability insurance of at least $1,000,000 per occurrence. We may ask for proof at any time. You are responsible for your own taxes. We may report payments made to you to tax authorities where the law requires.

7.3 Your prices. You quote for jobs from your rate card, within our pricing rules. When a customer accepts a price you quoted, you agree to do the work described for that price.

7.4 Approval. Nobody is sent work until we have approved them for a specific set of services that we confirm with you. We may suspend or withdraw approval at our discretion, including for work we cannot stand behind, for conduct toward a customer, for repeatedly accepting jobs and not arriving, or for any breach of these Terms.

7.5 Getting paid. For cash jobs, the customer pays you directly. For card jobs, you must complete Stripe's account set-up, including any identity checks Stripe requires. We transfer the full accepted price of each card job to your Stripe account after the customer's card is charged, and we pay the card processing fees.

7.6 What we charge you. Today, Homaru charges service providers no fees and takes no commission. This describes how we charge today, not a promise that it will stay the same. We may introduce fees, such as a subscription, a commission or a lead fee. If we do, we will tell you at least 30 days before they apply and ask you to accept updated terms. New fees will not apply to jobs you accepted before they took effect.

7.7 Your photos. Photographs of your work stay yours. By adding them to your profile, you give us a non-exclusive, royalty-free license to show them on your Homaru profile and in Homaru's own marketing, for as long as they are on your profile and for a reasonable time after you remove them. Do not upload photographs of work that is not yours, or that show a customer's home or belongings in a way they would object to.

7.8 Closing a provider account. To stop being a service provider on Homaru, contact support. You must complete, or release through us, any job you have accepted.

7.9 Responsibility for your work. You are responsible for the work you do, for anyone who works with you, and for any damage or injury caused by your work.

8. Behavior we do not allow

8.1 You must not, and we may suspend or close an account for, any of the following, including but not limited to: abuse, threats or harassment of anyone; discrimination; arriving impaired; asking for or taking payment outside the accepted price; misrepresenting who you are or what you are qualified to do; using Homaru for anything unlawful; interfering with Homaru or other people's use of it; or creating more than one account to get around a suspension.

8.2 We may suspend or close an account at our discretion where we reasonably believe it is needed to protect customers, service providers or Homaru. Where we can, we will tell you why.

9. What you share on Homaru

9.1 Customers. You give us, and the service providers we offer your job to, a non-exclusive license to use the descriptions, answers and photographs you add to a job, to arrange and carry out the job and to resolve any problem with it.

9.2 Reviews. When you review a job, you give us a non-exclusive, royalty-free license to show the review on the service provider's profile. We show it without your name. We may decline to publish, or remove, a review that breaks these Terms.

9.3 You confirm you have the right to share what you add, and that it does not break the law or anyone else's rights. If you believe something on Homaru infringes your rights, contact us at the address in section 19.

10. Messages and records

10.1 Customers and service providers talk through in-app messages. Homaru keeps a record of jobs, payments and messages, and our support team can read conversations to help resolve problems.

11. Text messages

By opting in you agree to receive job-related texts from Homaru as described in our Text Message Policy. Reply STOP to opt out, HELP for help. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

12. Disclaimers

12.1 Homaru is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties not stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

12.2 We do not guarantee that a service provider will be available for every request, that the app will always be available or free of errors, or the result of any work, except as section 6 states.

13. Limitation of liability

13.1 To the fullest extent the law allows, Homaru and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or relating to these Terms or Homaru, even if we were told they were possible.

13.2 To the fullest extent the law allows, our total liability for all claims arising out of or relating to these Terms or Homaru is limited to the greater of (a) the amount Homaru kept for the job the claim relates to, after paying the service provider, and (b) $100.

13.3 Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our gross negligence, fraud or willful misconduct.

14. Indemnity

14.1 You agree to defend, indemnify and hold harmless Homaru and its members, employees and agents from claims, losses and costs, including reasonable legal fees, arising from your breach of these Terms, your misuse of Homaru, or content you share.

14.2 Service providers also agree to do so for claims arising from their work, their staff, property damage or injury caused by their work, and their licenses, permits, insurance and taxes.

15. Disputes and arbitration

15.1 Talk to us first. Before starting any claim, send us a written notice describing it and the outcome you want, at the address in section 19. We will try to resolve it with you within 30 days.

15.2 Arbitration. If we cannot resolve it, you and Homaru agree that any dispute arising out of or relating to these Terms or Homaru will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (for customers) or Commercial Arbitration Rules (for service providers). The Federal Arbitration Act governs this section. The arbitrator decides all questions about whether a dispute must be arbitrated. Filing and arbitrator fees are paid as those rules provide; under the Consumer Arbitration Rules, a customer's share is limited and Homaru pays the rest.

15.3 Small claims. Either of us may bring an individual claim in small claims court instead, if it qualifies.

15.4 No class actions. You and Homaru may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims of more than one person. This does not stop you from reporting a concern to a government agency, or from receiving relief in an action brought by a government agency, such as the Texas Attorney General.

15.5 No jury. To the extent any dispute is decided in court, you and Homaru waive the right to a jury trial.

15.6 Opting out. You can opt out of this section 15 by emailing support@behomaru.com within 30 days after you first accept a version of these Terms that contains it (for people who used Homaru before this version, that is the day you accept this version), with your name, the phone number on your account, and a statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.

15.7 If section 15.4 is found unenforceable for a claim, that claim will be decided in court and not in arbitration, and the rest of this section still applies to other claims.

15.8 Changes to this section apply only to disputes arising after the change takes effect.

16. Governing law and courts

16.1 These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and by the Federal Arbitration Act for section 15.

16.2 Any dispute not subject to arbitration will be brought only in the state or federal courts located in Dallas County, Texas, and you and Homaru consent to their jurisdiction.

17. Changes to these Terms

17.1 We may update these Terms, for example to add services, features or payment options, to reflect changes in how we charge, or to follow the law. The current version is always on this page, with its version number and effective date.

17.2 We will tell you about every update by email or in the app before it takes effect. Updates apply going forward only.

17.3 If an update is material, we will ask you to accept the new version before you continue using Homaru, and we keep a record of which version you accepted and when. An update is material if it changes fees or prices, how you pay or are paid, your rights to a refund or remedy, limits on our liability, how disputes are resolved, or how we use your information. If you do not accept it, you can stop using Homaru and close your account. Jobs already booked continue under the version you agreed to.

17.4 Other updates, such as clarifications or additions that do not reduce your rights, take effect on the date stated in the notice. Continuing to use Homaru after that date means accepting them.

18. Ending your use of Homaru

18.1 Customers can close their account in the app, under Account. Service providers can close theirs by contacting support. An account with an unfinished or unpaid job cannot be closed until that job is settled.

18.2 We may suspend or close an account as section 8 describes.

18.3 Sections 6, 9, 12, 13, 14, 15, 16 and 19, and any payment owed, continue after an account is closed.

19. General

19.1 These Terms, with the Privacy Policy and Text Message Policy, are the entire agreement between you and Homaru about Homaru.

19.2 If any part of these Terms is found unenforceable, the rest stays in effect.

19.3 Our not enforcing a part of these Terms is not a waiver of it.

19.4 You may not transfer these Terms or your account to anyone else. We may transfer them in connection with a merger, acquisition or sale of our business.

19.5 We are not responsible for delay or failure caused by events beyond our reasonable control.

19.6 We send notices to you by email, in the app or by text message. Send notices to us at support@behomaru.com or by mail to Hetunex Labs LLC, 3209 Fountain Dr, Irving, TX 75063.
